The purpose of Donald Winch’s "historiographic revision" is to show that most recent interpretations of Smith have distorted his meaning because they have misread the intention of Smith’s work, treating it either as the first great justification of the nascent liberal capitalist polity, or as such a justification infiltrated by intimations of the Marxian notion of alienation. In Winch’s view, either account of Smith’s project is misleading by virtue of imposing nineteenth-century perspectives and categories upon "what is quintessentially a work (...) of the eighteenth century." The problem, then, is to determine the historically appropriate context or problematic within which the complex and at times paradoxical thought of the Wealth of Nations, the Theory of Moral Sentiments, and the Lectures on Jurisprudence can reasonably be situated. As Winch notes, his study is an application of the contextualist methodological principles of Quentin Skinner and J. G. A. Pocock, and is similar in design to recent works on Locke by John Dunn and on Hume by Duncan Forbes. (shrink)

As a democrat, he holds that political authority is legitimate only when it is controlled by widespread and egalitarian political participation; but such participation must not be allowed to obstruct individual freedom. As an empiricist, he holds that the business of the social scientist is to develop causal explanations and not only to interpret cultural significance; but such explanations must not be expressed as deductions from universal laws. In this (...) book, a "slightly different version" of a London School thesis written under Ernest Gellner, Merquior attempts to show that Rousseau and Weber, properly read, both support, or at any rate do not oppose, his own political and methodological preferences. The title of this interesting study may be misleading; Crocker's subject is not Rousseau's or Hegel's conception of liberty considered in contradistinction to, say, Locke's or J. S. Mill's. The philosophy of Positive Liberty is strictly English-speaking and its intention is to argue against those within the Lockean tradition who would claim that personal liberty can only be limited by deliberate human action. Crocker is in full agreement with his opponents in holding that passion or irrationality is in no way (...) an obstacle to liberty, but he wants to persuade negative libertarians that disabilities like poverty, powerlessness, physical handicap, and manipulative information management are conditions as seriously preventive of liberty as are forcible coercion and legal prohibition. His argument is that increasing liberty requires maximizing the range and desirability of opportunities and choices rather than simply minimizing deliberate or overt restraint. The consequence for political philosophy of this position, which Crocker calls left-libertarian, is that a social commitment to personal liberty may require extensive and costly positive redistributive policies. According to Crocker, positive liberty is not a new conception of liberty, but rather a novel and more inclusive sense of the obstacles to freedom: "the emphasis shifts from the constraints to the alternatives and such matters as their range and desirability. The absence of interference by other persons appears as but one feature of liberty among several". (shrink)

Della Volpe was a professor of philosophy, one of the leading theoreticians of the Italian Communist Party in the 50s and 60s, and one of the few prominent intellectuals to retain party membership following the Hungarian revolt. Nonetheless, his Marxism is distinctly heterodox. The main thrust of Rousseau and Marx, which contains an essay of that name as well as several short papers on Soviet legality and "materialist methodology," is to establish certain continuities between Marx’s thought and earlier philosophy. Fishkin defines tyranny as all acts of public policy which impose severe deprivations upon individuals in circumstances in which such deprivations are avoidable. His argument is that "virtually all of the principles currently prominent in political theory" will in some instances support or legitimate policies which tend to tyranny understood in this way. However, his parochial conception of what counts as currently prominent political theory makes his indictment considerably less universal than he apparently takes it to be. The style, questions, (...) and sources for the book are drawn entirely from the works of the liberal or public choice school in political philosophy. Fishkin’s critique is thus directed only at the kinds of principles developed by writers like Rawls, Nozick, and Buchanan and Tullock; but precisely because it is so wholly within the tradition it criticizes, the book provides a challenge to that tradition which manages to be both fundamental and free from tendentiousness. Subjects classified visible 2-digit numbers as larger or smaller than 55. Target numbers were preceded by masked 2-digit primes that were either congruent (same relation to 55) or incongruent. Experiments 1 and 2 showed prime congruency effects for stimuli never included in the set of classified visible targets, indicating subliminal priming based on long-term semantic memory. Experiments 2 and 3 went further to demonstrate paradoxical unconscious priming effects resulting from task context. For example, after repeated practice classifying 73 as larger (...) than 55, the novel masked prime 37 paradoxically facilitated the “larger” response. In these experiments task context could induce subjects to unconsciously process only the leftmost masked prime digit, only the rightmost digit, or both independently. This paper contributes to the generalization of lattice-valued models of set theory to non-classical contexts. First, we show that there are infinitely many complete bounded distributive lattices, which are neither Boolean nor Heyting algebra, but are able to validate the negation-free fragment of \. Then, we build lattice-valued models of full \, whose internal logic is weaker than intuitionistic logic. We conclude by using these models to give an independence proof of the Foundation axiom from \.

We present a case study for the debate between the American and the Australian plans, analyzing a crucial aspect of negation: expressivity within a theory. We discuss the case of non-classical set theories, presenting three different negations and testing their expressivity within algebra-valued structures for ZF-like set theories. We end by proposing a minimal definitional account of negation, inspired by the algebraic framework discussed.

Background: Older, frail patients with multimorbidity are at an especially high risk for disease severity and death from COVID-19. The social restrictions proved challenging for the residents, their relatives, and the care staff. While these restrictions clearly impacted daily life in Norwegian nursing homes, knowledge about how the pandemic influenced nursing practice is sparse. Aim: The aim of the study was to illuminate ethical difficult situations experienced by Norwegian nurses working in nursing homes during the COVID-19 pandemic. Research design and (...) participants: The research design involved semistructured individual interviews conducted with 15 nurses working in 8 nursing homes in 3 health regions in Norway, within both urban and rural areas. Ethical considerations: Oral and written information about the study was provided before the participants gave their written consent. The transcribed interviews were de-identified. The study was approved by the Norwegian Centre for Research Data. Findings: Four ethical difficult situations were identified: (a) turning the nursing home into a prison; (b) using medication to maintain peace and order; (c) being left alone with the responsibility; and (d) s. impact on decision-making. Conclusions: The nurses’ ethical challenges were intertwined with external factors, such as national and local guidelines, and the nurses’ own internalized factors, which were connected to their subjective professionality. This duality inflicted emotional distress and gave nurses few opportunities to perform nursing in a professionally sound and safe manner. (shrink)

Background: In Switzerland, non-medical right-to-die organisations such as Exit Deutsche Schweiz and Dignitas offer suicide assistance to members suffering from incurable diseases. Objectives: First, to determine whether differences exist between the members who received assistance in suicide from Exit Deutsche Schweiz and Dignitas. Second, to investigate whether the practices of Exit Deutsche Schweiz have changed since the 1990s. Methods: This study analysed all cases of assisted suicide facilitated by Exit Deutsche Schweiz (E) and Dignitas (D) between 2001 and 2004 and (...) investigated by the University of Zurich’s Institute of Legal Medicine (E: n = 147; D: n = 274, total: 421). Furthermore, data from the Exit Deutsche Schweiz study which investigated all cases of assisted suicide during the period 1990–2000 (n = 149) were compared with the data of the present study. Results: More women than men were assisted in both organisations (D: 64%; E: 65%). Dignitas provided more assistance to non-residents (D: 91%; E: 3%; p = 0.000), younger persons (mean age in years (SD): D: 64.5 (14.1); E: 76.6 (13.3); p = 0.001), and people suffering from fatal diseases such as multiple sclerosis and amyotrophic lateral sclerosis (D: 79%; E: 67%; p = 0.013). Lethal medications were more often taken orally in cases assisted by Dignitas (D: 91%; E: 76%; p = 0.000). The number of women and the proportion of older people suffering from non-fatal diseases among suicides assisted by Exit Deutsche Schweiz has increased since the 1990s (women: 52% to 65%, p = 0.031; mean age in years (SD): 69.3 (17.0) to 76.9 (13.3), p = 0.000), non-fatal diseases: 22% to 34%, p = 0.026). Conclusions: Weariness of life rather than a fatal or hopeless medical condition may be a more common reason for older members of Exit Deutsche Schweiz to commit suicide. The strong over-representation of women in both Exit Deutsche Schweiz and Dignitas suicides is an important phenomenon so far largely overlooked and in need of further study. (shrink)

She received many awards and honours, including the Association for Computing Machinery Salton Award in 1988; the American Society for Information Science and Technology Award of Merit in 2002; and the joint Association for Computing Machinery and Association for the Advancement of Artificial Intelligence Allen Newell Award in 2007. Karen also worked hard to try to improve the position of women in computing and to attract (...) more women to the discipline. The degree of success in creating quality care for people suffering from dementia is limited despite extensive research. This article describes Healthcare providers’ experience with the ethical challenges and possibilities in the relationship with patients suffering from dementia and its impact on quality care. The material is based on qualitative, in-depth individual narrative interviews with 12 professional Healthcare providers from two different nursing homes. The transcribed interview texts were subjected to a phenomenological–hermeneutical interpretation. To provide quality care to patients with (...) dementia, the Healthcare providers emphasized the importance of sensing and understanding the patients’ emotional and bodily expressions through sentient attentiveness and recognition of the patient as a person. They also described reciprocity of expressions in the relationship where the patient recognized them both as persons and Healthcare providers. The analyses of the findings are, inter alia, discussed in light of Løgstrup’s relational philosophy of ethics. (shrink)

This work provides a text and an extended study of those fragments of Heraclitus' philosophical utterances whose subject is the world as a whole rather than man and his part in it. Professor Kirk discusses fully the fragments which he finds genuine and treats in passing others that were generally accepted as genuine but here considered paraphrased or spurious. In securing his text, Professor Kirk has taken into account all the ancient testimonies, and in his critical work he attached particular (...) importance to the context in which each fragment is set. To each he gives a selective apparatus, a literal translation and and an extended commentary in which problems of textual and philosophical criticism are discussed. Ancient accounts of Heraclitus were inadequate and misleading, and as Kirk wrote, understanding was often hindered by excessive dogmatism and a selective use of the fragments. Professor Kirk's method is critical and objective, and his 1954 work marks a significant advance in the study of Presocratic thought. (shrink)

Over the past two years, debate about the use of data taken from Nazi concentration camp experiments has intensified. Many survivors of the Holocaust have been particularly offended at the publication of hypothermia or other data. This article argues against the use of unethically obtained data, and considers the debate from the perspective of the rights of Holocaust victims.

Popper proposes a technical concept of 'verisimilitude' as a test of the progressiveness of scientific theories. The paper attempts to show its uselessness and inapplicability on mathematical and practical grounds, As well as raising doubts about the value of any such attempt to give a mechanical test of scientific progress.

The sequencing of the human genome and decreasing costs of sequencing technology have led to the notion of ‘personalized medicine’. This has been taken by some authors to indicate that personalized medicine will provide individualized treatments solely based on one’s DNA sequence. We argue this is overly optimistic and misconstrues the notion of personalization. Such interpretations fail to account for economic, policy and structural constraints on the delivery of healthcare. Furthermore, notions of individualization based on genomic data potentially take us (...) down the road of genetic reductionism obscuring the role of environmental factors in disease and ill health. We propose that one should see personalized medicine as a way of using personal genomic information to stratify individuals into subpopulations and suggest that personalized medicine be seen within a broader idea of personalized healthcare, reflecting healthcare that integrates personal genomic data into cultural, environmental and personal contexts.
